TRAVEL: Client Understand that a Travel fee between $25 - $35 will apply per artist. Client is also responsible for any toll fees, parking fees, or park/facility entry fees. Client understands that if any of the above fees apply, they will be added to the clients remaining balance

BOOKING DATE: The time slot will not be reserved for Client until the retainer fee is paid and the agreement is signed. Should the Artist be unable to perform its contracted services, the Artist will make their best effort to obtain a suitable and equivalent replacement. Should Artist be unable to perform or to find such a replacement, the retainer fee and any amounts paid by the Client under this contract agreement, will be refunded, with the exception of any special supplies purchased for the Client, at the Client’s request, in which case the cost of the special items purchased will be deducted from the amount refunded and the specialty items will be available for the client to pick up from the Artist.

RETAINER FEE & LATE FEES: There will be a 50% NON- Refundable Retainer fee due when you book your party/event. This is required to hold your date. The 50% Retainer will be applied towards the clients remaining balance. The retainer fee may be paid via PayPal/Venmo/Cash upon completion of agreement. Remaining balance including (if any) traveling fee, and any additional services MUST be paid 24 hours (1 day) before the party/event date.(Unless previously discussed) Payments can be made online/Paypal/Venmo/Cash. (Checks not accepted unless previously discussed) The balance left will be due BEFORE any services are performed. Accounts not paid within 14 days after services are rendered are subject to a $30 late fee.

CANCELLATIONS: If the need to reschedule a date for any reason please be advised there is no guaranteed accommodations. Retainer fee will be held and used towards the rescheduled date. In the event that the client cancels prior to the event client will lose their retainer.

OVERTIME & BREAKS: Any time beyond the time booked will cost the hourly rate per hour and per artist or half the hourly rate per half hour each artist, with a full half hour charge being due for each 1-30 minutes of overtime. However, only booked times with retainers are guaranteed, additional time on day of event may not be available, although Artist will attempt to accommodate requests for additional paid time. Artists will be provided with paid 15-minute breaks for every 3 hours of contracted time. Masked Characters will require 5 Minute breaks within each hour.

PARKING: Artists will be provided with parking in the driveway of the home where services will be provided or in front of the home near the entrance.If the event is at a commercial facility, Artist will be provided a parking spot next to the commercial facility entrance door. Parking near the place services are provided is necessary to enable the Artist to unload equipment. The Client will reimburse Artist for any parking fees incurred while the Artist is providing its contract agreement services to the Client.

EXTREME ADVERSE WORKING CONDITIONS: Artist has the right to cease services and leave without refunding any monies if there are extreme adverse working conditions and the Client fails to remedy the situation after it has been brought to the Client’s attention. Adverse conditions included but not limited to: destructive, violent, or extreme; inappropriate behavior; illegal activities; dangerous weather or work environment conditions; dangerous conditions in general. Face Painting by Wandie will not cancel but we will agree to a rain date if discussed 3 days prior to the event.

LIABILITY STATEMENT: Artists are not liable for any parties’ allergic reactions to paints and/or products. FDA compliant paints and cosmetic grade glitters are used for face painting and 100 % organic henna. Children with skin allergies or sensitive skin should either not participate, or have Artist perform a patch test at the beginning of the party. For safety reasons, artists will not paint children under 3 years old. For sanitary reasons, artists will not paint anyone who is or appears to be sick or suffering from: cold sores; conjunctivitis; any infectious skin condition; eczema or open wounds. Artists will use reasonable care,and are not responsible for damage to clothing or property.

WATERPROOF/ALCOHOL BASED FACE PAINTS, AIRBRUSH TATTOOS: These are temporary waterproof tattoos that are created using waterproof FDA approved cosmetic grade alcohol based paints. They can last 1-5 days with the proper care or they can be removed the same day. For longer lasting tattoos do not scratch or rub with towel. Removal: Apply rubbing alcohol along with soap and warm water. Recommended for ages 5 and up. These services require easy access to electricity. Please ensure that the area the Artist will set up in has access to electricity.

ARTIST WILL NOT SUPERVISE: The behavior and safety of all children and adults is the Parents’ responsibility, and not the Artist’s. Artist cannot see other children and what they are doing while they are painting.

GENERAL PROVISIONS: (a) In the event Client shall fail to pay any periodic or installment payment due hereunder, Contractor may cease work without breach pending payment or resolution of dispute. (b) Artist shall not be liable for any delay or non-performance due to circumstances beyond her control. (c) Artist is an independent contractor and not an employee of Client. (d) Any changes to this document must be signed by both Artist (Contractor) and Client. (e) This Agreement constitutes the entire agreement between the Client and Artist, and supersedes any prior understanding or representation of any kind preceding the date of this Agreement. There are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this Agreement.

ARTIST AGREES to provide services listed on said contract agreement dates, with acceptance and timely payment of 50% retainer. For any reason, should the Artist be unable to accommodate your paid booking, or provide a suitable and comparable replacement, a full refund of your deposit will be returned to you or you may receive your next event for the equal amount of time, provided you and the Artist can agree on an available day and time period for the next event and the next event is to occur within a reasonable period of time. In the event that Artist is unable to perform or provide a suitable replacement, Client agrees that a full refund of any amounts paid to Artist will represent a full satisfaction of any and all amounts due from Artist and a demand for the full amount paid to Artist the Client’s full recourse for any and all claims by Client. This means that the Artist is liable to Client for no further claim of damages or other claims of any kind whatsoever, beyond a full refund of any amounts paid by Client to Artist.

CLIENT AGREES to pay the full amount for services due. The client will be responsible for any fees or expenses, including attorney’s fees, NSF/Return fees, incurred in connection with collecting delinquent amounts owed to the Artist under this Agreement. To provide sheltered area in event of rain. To provide a shaded area in extreme heat.

CHARACTERS: Characters may vary in looks. Not all characters will speak. Most characters will interact by doing dance performances,photo ops, and more!

By signing this contract, I have read and understand all the terms and conditions outlined above. I understand that I will be financially responsible for self, and others listed above (if any) and all retainer fee(s) made are non-refundable. I will abide by this contract. This contract is binding. I accept the Terms and Conditions.
